The Service uses artificial intelligence to generate, edit, and enhance images based on your inputs. AI-generated outputs may vary in quality, accuracy, and style, and may not always meet your expectations or intended use.

You are responsible for reviewing AI-generated content before relying on, publishing, or distributing it. You agree not to use the Service to create content that is unlawful, infringing, harmful, or otherwise prohibited under these Terms.

You are solely responsible for the prompts you submit, the content you upload, and the images you generate, as well as how you use them.

• Ensure you have the necessary rights to any content you upload or reference.
• Use generated content responsibly and in compliance with applicable laws.
• Do not misrepresent AI-generated content in a deceptive or harmful manner.
• Maintain the security of your account and credentials.

The Service, including its software, design, branding, and underlying technology, is owned by BiotiqueAI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary materials.

Subject to your compliance with these Terms and payment of applicable fees, you retain ownership of the images you generate on paid plans, along with the commercial usage rights described in your plan. Free-plan content is licensed for personal and evaluation use.

You agree not to engage in any of the following while using the Service:

• Violating any law or infringing the rights of others.
• Generating unlawful, harmful, hateful, or deceptive content.
• Attempting to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Reselling or redistributing the Service without authorization.
• Using the Service to develop a competing product through improper means.

Paid plans are billed on a recurring basis according to the plan you select. By subscribing, you authorize us to charge the applicable fees through your chosen payment method until you cancel.

Fees are exclusive of applicable taxes unless stated otherwise. You may upgrade, downgrade, or cancel your plan in accordance with the options described at the time of purchase. Except where required by law, fees are non-refundable.

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

We may suspend or terminate your access to the Service at any time if you violate these Terms or if necessary to protect the Service or other users. You may stop using the Service and cancel your account at any time.

Upon termination, your right to use the Service ceases, though provisions that by their nature should survive will continue to apply.

To the maximum extent permitted by law, BiotiqueAI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

You agree to indemnify and hold harmless BiotiqueAI and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

We may update these Terms from time to time. When we make material changes, we will revise the “Last Updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
